Practice Areas
Francesca mainly focuses on providing legal advice and judicial assistance in civil law and, in particular, in health law matters, insurance law, and in general in civil liability cases, with particular emphasis on professional responsibility and medical malpractice cases. In the course of her career, Francesca assisted clients in a large number of legal actions before the Italian Courts, representing both medical doctors and large public and private health facilities as well as patients. She always pays attention not only to the direct relationship that develops between doctor and patient, but also to the complex relationships that arise when a person is the recipient of health care treatments.
Francesca has been actively practicing many years in the medical malpractice area which she considers an ever-evolving field that requires particular attention, especially in our time in which a new culture of the patient-physician relationship is developing. Such culture is leading on one hand to make the patient increasingly intolerant towards the so-called “medical error”, and on the other hand, it is forcing the medical doctors to close-up in a purely “defensive” rather than proactive attitude, with all the negative consequences for the protection of the people constitutionally protected right to health.
Francesca also provides legal advice to public and private hospitals and health facilities in the evaluation and the management of the so-called “clinical risk”, particularly in the identification of adverse events, to the adequacy of the medical record, and to the preparation of proper informed consent forms. As regards to the clinical risk, she also provides legal advice to health facilities in development management software systems adequate to support the processes of incident reporting.
In addition, Francesca, has represented several clients victims of infected blood transfusion in Public Hospitals, among which individual and class actions against the Health Ministry.
She is active in the area of pharmaceutical law and, recently, she has been involved in the analyses of the issues that pharmacists face with regard to the replacement of branded medications with the generic equivalent.
Francesca has also worked with a leading administrative law firm (Prof. Angelo Clarizia) based in Rome, assisting, counseling, and defending clients before administrative Courts in all major areas of administrative law, with particular regard to public procurement, health law, concessions, and public competitions (1994-1998); she has also been active in a number of arbitration disputes concerning the execution of public and private tenders. She was has then practiced with a well-known boutique law firm in Rome, dealing mainly with litigation cases, in the context of insurance law and civil liability, with particular regard to professional responsibility and medical malpractice cases (1999- 2009), representing many private and public medical clinics and hospitals.
